Shri Vinay Kumar Jain, Counsel and Shri Biplab Dutta, EE for petitioner. Shri Ankit Agrawal, Shri Atul Kumar, Shri Bharat Kumar Reddy Yellasiri for respondent SECI. 2. Heard the parties. 3. The petitioner CSPDCL has filed this petition seeking approval for procurement of solar power on long-term basis from 100 MW (AC) solar power plant with 50 MW150 MWh energy from battery storage, to be set up by Solar Energy Corporation of India Ltd. (SECI), a Govt. of India Enterprise, in the State of Chhattisgarh and for approval of Power Purchase Agreement (PPA) dated 13.02.2020 executed between the petitioner and respondent. 4. The Commission has gone through the regulatory process and published public notices in the local newspapers. No objection suggestion has been received. 5. The petitioner, being an obligated entity, is required to procure certain percentage of its total energy procurement as renewable energy, including solar energy, on year-to-year basis, in order to comply with the renewable purchase obligation (RPO). Presently, there is substantial shortfall in solar RPO compliance of CSPDCL and the proposed solar energy procurement from SECI’s 100 MW (AC) solar power plant will go a long way in meeting its solar RPO. 6. Considering pleadings and arguments of the parties, we are of the view that the PPA executed between the parties is valid and nothing in the PPA is observed against public policy and, therefore, approve it. |
