The Commission had heard the parties on merit in this petition on 28.04.2020. The petition was filed praying relaxation in payment of monthly energy bills falling within the period of 23.03.20 to 31.03.20, keeping in view of COVID-19 lockdown enforced by the Government. After the hearing, a request from the petitioner was made to the Commission to consider adjustment of their security deposit amount (equivalent to two months bill amount) against the electricity bill for the period 1st March 2020 to 22nd March 2020 keeping in view the cash-flow problem being faced by the petitioner on account of COVID-19 pandemic lockdown. After hearing the views the Commission had passed an interim order as follows:
“The respondent i.e. CSPDCL may deduct 70% of the total billed amount for the month of March 2020 from the security deposit of the petitioner(s) held by the CSPDCL, and the same amount shall be replenished within 30 days from the date of re-commissioning of the unit(s).“ The Commission has reviewed the interim order and has decided to put the same on hold. Accordingly, operation of the above order is hereby stayed. The matter shall be dealt with at the time of passing the final order in Petition No. 43 of 2020. Parties be informed accordingly. |

The petition was heard today, keeping in view the urgency of the matter on account of the COVID lockdown.
Shri Ashish Barnard, counsel for the petitioner is allowed to appear join via video conferencing. Shri Arun Poddar, Shri Vinay Kumar Agrawal and Shri Shyam Kabra for the petitioners. Shri Abhinav Kardekar and Ms. Gurpreet Kaur Chawla, Counsels along with Shri M.H. Prasad, CE and Shri V.A. Deshmukh, EE for respondent. 2. The respondent was served with the copy of the petition and has submitted the reply with copy to the petitioner. 3. Looking to the urgency of the matter, the Commission heard both the parties on merit. The case is reserved for order. 4. After arguments by both the parties, the petitioner(s) came up with a request to allow them to defer payment of the electricity dues from 01.03.2020 to 23.03.2020 i.e. the date of enforcement of lockdown by the State Government. They prayed that because of the force majeure situation, they are being faced with acute cash-flow problem and uncertainty still persists on the issue of lifting of the lockdown. Besides, they have to make payment of salary and wages as well. 5. After detailed discussion with both the parties on this issue, the Commission decides as follows: “The respondent i.e. CSPDCL may deduct 70% of the total billed amount for the month of March 2020 from the security deposit of the petitioner(s) held by the CSPDCL, and the same amount shall be replenished within 30 days from the date of re-commissioning of the unit(s).” |
