2. Shri Robin Gupta submitted letter no. 2740 dated 01.03.2021, vide which those terms and conditions are communicated, on which both the parties agreed, if the petitioner replaces it’s existing captive power plant by a solar power plant.

3. The Commission feels that study of the proposal is required keeping in view the provisions of the RE Regulations.

2. The petitioner informed that as per advice of the Commission, several meetings held between the parties and a fruitful outcome is expected soon for which he sought time. Considered the request and allowed two weeks time.

2. The petitioner informed that as advised by the Commission in hearing held on 02.12.2020, meetings held between the parties, but no consensus could be reached. He seeks three weeks time for resolving the issues mutually. Considered the request and allowed three weeks time.

2. The petitioner submits that the meeting with CSPDCL to resolve the issues could not be held due to unavoidable reasons. Hence, seeks time for resolving the issues. Considered the request and allowed two weeks time.

2. During the course of hearing, Ms Chawla requested that issues of this case are similar to Suo-Motu petition No. 61 of 2020 and, therefore, the case be heard with the petition No. 61 of 2020.
3. The petitioenr submits that their case is different as it relates to substitution of conventional plant by the solar plant.
4. Considering the submission of the petitioner, we direct him to give their proposal within a week and provide copy to the respondent. The respondent may make submission on the proposal at least a day before the next date of hearing.
5. If the parties think appropriate, they can meet together and discuss the proposal to arrive at an amicable solution.
6. The case is fixed for discussion on proposal on 22.12.2020 at 3:30 PM.
8 07-10-2020 The case was listed for hearing on 03.09.2020. Due to detection of Covid-19 cases in the office of the Commission, office was closed and, therefore, the case was adjourned.

2. The respondent’s counsel Shri Abhinav Kardekar filed an application on 17.03.2020 for adjournment on account of notification dated 16.03.2020 issued by the Hon’ble High Court of Chhattisgarh regarding fight against Corona Virus. It is intimated by petitioner also that due to precautionary advice given by the Central Government against the global pandemic Corona Virus, the counsel for petitioner Shri Raunak Jain who comes from Delhi, is unable attend hearing today and seeks postponement.

3. Considered the request and accepted them.

4. The petitioner seeks time for filing of rejoinder. The petitioner is allowed three weeks time for filing of rejoinder with copy to the respondent.
